Does causing a rear-end car accident in St. Petersburg mean that I’m at fault?

This is a question that comes across our desks quite often here at PERENICH The Law Firm. Many people assume that since they were the person that rear-ended another car, the fault of the accident automatically resides on them. Don’t assume anything. First ask yourself these three questions below:

  1. Is there evidence that a mechanical failure impaired your ability to timely stop?
  2. Is there evidence that the vehicle in the front suddenly and unexpectedly stopped or pulled into your path of travel?
  3. Is there evidence that a vehicle was illegally stopped on the roadway?
    • OR is there evidence that the operator of the front vehicle unexpectedly stopped or slowed down when there was no reason for a motorist traveling behind to anticipate that the front vehicle would stop or slow down?

In 2012 the Florida Supreme Court ruled:

“Where evidence is produced from which a jury could conclude that the front driver in a rear-end collision was negligent in bringing about the collision—or that the negligence of the rear driver was not the sole proximate cause of the accident—the presumption that the rear driver’s negligence was the sole proximate cause of the collision is rebutted, and all issues of disputed fact regarding comparative fault and causation should be submitted to the jury.”
