For those of you who aren’t aware of Florida’s wrongful death law, it may come as a surprise that it doesn’t take to heart all the family members of victims who suffer a loss in times where human error or negligence was involved on the part of the medical team.

 The Florida Wrongful Death Act stipulates that legal action by the parent of an adult child cannot be taken against medical staff for negligence. Similarly, an adult child cannot take legal action in the event of a parent’s death due to negligence.

  While the act adequately covers spousal and dependent survivors, the parent of the adult child victim cannot claim for damages, whether mental, emotional or physical.
